These Terms of Service ("Terms") govern your use of WaiverBox, a digital waiver creation and management service operated at waiverbox.app. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use WaiverBox.

1. Service Description

WaiverBox provides a software-as-a-service (SaaS) platform for businesses to create digital liability waiver templates, collect signatures from their customers, and manage signed waiver records. The service includes:

• Waiver template creation with a visual editor and AI-assisted text generation
• QR code and shareable link generation for each waiver template
• Digital signature collection (typed or drawn) with timestamps and IP logging
• Searchable signed waiver records dashboard
• CSV export of signature records

2. Account Responsibilities

When you create a WaiverBox account, you agree to:

• Provide accurate and truthful registration information (email, business name)
• Keep your password secure and not share your account credentials with others
• Promptly notify us at support@waiverbox.app if you suspect unauthorized access to your account
• Be responsible for all activity that occurs under your account

You must be 18 years of age or older to create an account. Accounts may be used by one business entity. Each business should maintain its own account.

3. Acceptable Use

You agree to use WaiverBox only for lawful purposes. You may not use WaiverBox to:

• Create waivers for illegal activities, fraudulent schemes, or activities designed to harm others
• Collect signatures from individuals under false pretenses or without their informed consent
• Spam or send unsolicited communications using waiver signing links
• Attempt to reverse-engineer, hack, or disrupt the WaiverBox platform
• Scrape, crawl, or extract data from WaiverBox using automated means without permission
• Resell or sublicense access to WaiverBox to third parties
• Impersonate another business or person in your waiver templates

WaiverBox reserves the right to suspend accounts that violate these rules without refund.

4. Free and Pro Plan Limits

Free Plan

• Up to 3 active waiver templates
• Unlimited signature collection on those templates
• QR code sharing and signing links
• Basic signature record search
• AI waiver generation: up to 3 uses

Pro Plan ($9/month)

• Unlimited waiver templates
• Unlimited signatures
• CSV export of all signature records
• Unlimited AI waiver generation
• Priority email support (response within 1 business day)
• Custom branding options

Plan limits may be adjusted with 30 days' notice. Existing subscribers on Pro will not have their unlimited features restricted without equivalent notice and the option to cancel without penalty.

5. Payment Terms

The Pro plan is billed at $9.00 per month. Billing is handled securely by Stripe.

• Billing cycle: Monthly, charged on the anniversary of your upgrade date
• Cancellation: Cancel anytime from your account dashboard. You retain Pro access until the end of the current billing period — no partial refunds for unused time
• Failed payments: If a payment fails, we will retry for 3 days. After that, your account reverts to the Free plan. Your data is preserved
• Price changes: We will give 30 days' notice before changing the Pro plan price. You may cancel before the new price takes effect
• Refunds: We offer a 7-day money-back guarantee for first-time Pro upgrades. Contact support@waiverbox.app within 7 days of upgrading

6. Data Ownership

You own your data. All waiver templates you create and all signature records collected through your WaiverBox account belong to you and your business. WaiverBox acts as a hosting provider and data processor on your behalf.

You grant WaiverBox a limited license to store, process, and display your data solely for the purpose of providing the service to you. We do not claim ownership of your waiver content or your customers' signatures.

You are responsible for your waiver templates — their legal sufficiency, accuracy, and appropriateness for your jurisdiction and use case.

7. Limitation of Liability

WaiverBox provides its service "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law:

• WaiverBox is not liable for any indirect, incidental, special, consequential, or punitive damages
• WaiverBox is not liable for the legal enforceability of waivers created using our platform — consult your attorney
• WaiverBox's total liability to you for any claim arising from these Terms or your use of the service is limited to the amount you paid us in the 3 months preceding the claim
• WaiverBox is not responsible for data loss resulting from user error, account deletion, or events beyond our reasonable control

Some jurisdictions do not allow limitation of liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify and hold harmless WaiverBox, its team, and its affiliates from any claims, damages, costs, or legal fees arising from: (a) your use of the service, (b) waiver templates you create, (c) your violation of these Terms, or (d) your violation of any applicable law or third-party rights.

9. Termination

Termination by you

You may close your account at any time from your dashboard or by emailing support@waiverbox.app. Upon closing your account, all your data will be permanently deleted within 7 business days. Export your data before closing.

Termination by WaiverBox

We may suspend or terminate your account with immediate effect if:

• You violate these Terms (especially the Acceptable Use section)
• Your account is used for fraudulent or illegal activity
• Your account payment remains delinquent beyond the grace period

For non-abuse-related terminations (e.g., service shutdown), we will provide 30 days' notice and a data export.

10. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email to your registered account address and a notice on our website. If you do not agree with the updated Terms, you may cancel your account before the changes take effect. Continued use after the effective date constitutes acceptance.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of WaiverBox shall first be attempted to be resolved informally by contacting support@waiverbox.app. If informal resolution fails, disputes shall be resolved in the courts of Delaware, and you consent to personal jurisdiction in those courts.

12. Miscellaneous

• Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and WaiverBox regarding the service
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force
• No waiver: WaiverBox's failure to enforce any right or provision does not constitute a waiver of that right
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger or acquisition
